The Board of Zoning Appeals (BZA) hears and decides requests for variances from the standards identified in the Unified Development Ordinance. The BZA also hears and makes final decisions on conditional use requests. In addition, the BZA makes the final decision concerning appeals regarding administrative decisions.
A variance is a request to deviate from current zoning requirements. This application is specifically for deviation from required development standards in a given zoning district, such as but not limited to the following standards: setbacks, architecture, parking, accessory dwellings, signs etc. If granted, it permits the owner to use land in a manner not otherwise permitted by the zoning ordinance, it is not a change in zoning law, but a specific waiver of requirements.

The appeal procedure is provided as a safeguard against arbitrary, ill-considered, or erroneous administrative decisions. It is intended to avoid the need for legal action by establishing local procedures to review and correct administrative errors. It is not, however, intended as a means to subvert the clear purposes, meanings, or intent of the Unified Development Code of the Town of Pendleton or the rightful authority of the Planning Director to enforce the requirements of this Code.
